June 8 (Bloomberg) -- The U.S. Supreme Court refused to question the “don’t ask, don’t tell” policy that prohibits openly gay people from serving in the military, turning away a constitutional challenge to the ban.
The rebuff spares President Barack Obama’s administration from the awkward task of mounting a legal defense for a policy the president says should be repealed.

More than 100 retired generals and admirals called Monday for repeal of the military's "don't ask, don't tell" policy on gays so they can serve openly, according to a statement obtained by The Associated Press.
The move by the military veterans confronts the incoming administration of President-elect Barack Obama with a thorny political and cultural issue that dogged former President Bill Clinton early in his administration.

Armed Forces celebrates diversity with gay serviceman in Soldier magazine
Nine years after it lifted its ban on homosexuality, the Armed Forces has celebrated its diversity by putting James Wharton, a gay serviceman, on the front cover of Soldier magazine.

Trooper Wharton has served in The Household Cavalry Regiment for the past six years and came out after his initial training was over.
"I came out to the Army before I told my parents, so that says a lot for the Armed Forces," said the 22-year-old.
