FL Judge: Droopy Drawers Are a Constitutional Right

In 2008, 72 percent of voters in Riviera Beach, FL, passed a ban on pants that ride below the waist exposing skin or underwear. But wait: turns out loose waistbands are a civil liberty. A judge ruled this week that the ordinance violated the 14th amendment of the constitution, because there was no legitimate government interest in the law regulating style.

The city argued that the ban on saggy pants wasn't based on sartorial concerns, but safety concerns, since residents could hide weapons in their loose-fitting clothes. The judge didn't buy that.

Police in various states around the country have cracked down on baggy pants. In Flint, MI, the new chief announced last year that he would begin arresting people with droopy drawers for indecency and make offenders face a $500 fine and up to three months in jail.

In addition to the judge in Florida, the laws have raised the concerns of the ACLU and the NAACP, which worry about the racial implications. They think the baggy ban has the potential to disproportionately target the black community.

Two Out of Three Americans Living in Constitution-Free Zone

Welcome to the border - where anyone can be stopped and searched. It used to be just the point of entry along Canada and Mexico, but Homeland Security has taken an increasingly loose - or wide - interpretation of it. Now? It's a 100-mile radius that wraps around the border of the United States.

Oh yes. It’s called the Constitution-Free Zone by the ACLU. The concern is that it erodes the rights of the Fourth Amendment - the one that protects against unreasonable searches and seizes - for two-thirds of Americans. That's 197.4 million people, and pretty much all of New England.

Authority that the Constitution would have prohibited can now be exercised by the US Customs and Border Protection. It’s been setting up inland checkpoints where it typically questions citizenship; however, people have reported extended questioning and increased pressure to permit searches.

Many are calling for congress to investigate and pass new laws to protect Americans before things go too far. Do you fear it will? Or are you glad to see a protective barrier ringing the country regardless?

The Decider Says He Doesn't Have to Follow Certain Laws

After signing two bills into law this week, President Bush said that he could bypass numerous parts of the laws. In a signing statement Bush said a military authorization act and a measure giving inspectors general greater independence from the White House unlawfully constrained the president's constitutional powers.

So which parts will Bush ignore?

A section forbidding money from being used "to exercise United States control of the oil resources of Iraq."
A section requiring negotiations for an agreement by which Iraq would share some of the costs of the American military operation.
Two sections strengthening legal protections against political interference with internal watchdog officials at executive agencies.

The past 42 presidents have issued 600 signing statements combined while Bush himself has put out 1,100. Legal scholars assert that Bush's disobedience contradicts the rule of law, and the separations of power between Congress and the president. When political or moral conversation gets heated, we always add in our two cents, and most times much more. But what if you could actually change the laws on the issues you don't agree with? Drug Testing in Public Schools, A Good Idea?

We have all heard about random drug testing in our respective places of employment and in professional sports, but what about in public schools?

The White House Office of National Drug Control Policy recently announced that it would be holding four regional summits promoting random student drug testing in public middle and high schools. The program, which has actually already been implemented in almost 1,000 schools across the country, requires that kids submit to random drug testing if they would like to participate in sports and other extracurricular activities. The tests would be looking for cocaine, marijuana, ecstasy, opium-based substances, oxycontin and steroids.

Gay Marriage Supporters Cheer as Appeals Court Rules Prop 8 Is Unconstitutional

A federal appeals court has reaffirmed that California's gay-marriage ban is unconstitutional. Today, the Ninth Circuit Court of Appeals found that voter-passed Proposition 8 violates the 14th Amendment of the US constitution. Gay marriage supporters outside the courthouse in San Francisco cheered the decision, but the fight isn't over yet. The case will likely make it to the US Supreme Court as early as next year.

The court's ruling stated: “Proposition 8 served no purpose, and had no effect, other than to lessen the status and human dignity of gays and lesbians in California." The court also refused to throw out the decision of lower court judge, retired Chief US District Judge Vaughn R. Walker, on the basis of his sexual orientation. After the trial, Judge Walker, who is openly gay, revealed that he has been in a same-sex relationship for 10 years. See photos of the celebrations now.

Mississippi Votes to Keep Birth Control, IVF, & Abortion Legal

Earlier this week feminist icon Gloria Steinem told us that reproductive rights were the single biggest accomplishment for women she's witnessed. Yesterday Mississippi voters had a chance to roll back the clock by passing a ballot measure that would have defined a fertilized egg as a person. They voted against it.

Initiative 26 would have added this language to the state's constitution: "The term ‘person' or ‘persons' shall include every human being from the moment of fertilization, cloning or the functional equivalent thereof." By giving personhood rights to a fertilized egg, the amendment would have banned abortion, even in the case of rape or incest, and would have also outlawed in vitro fertilization and IUDs.

Birth control like the pill or Plan B would have likely been banned too, since many forms of hormonal birth control prevent a fertilized egg from attaching to the uterus, should the hormones fail at preventing fertilization in the first place. Critics also warned that any miscarriage could initiate a criminal investigation if the measure passed.

The initiative sponsored by Personhood USA was put up for a vote in Mississippi because it is one of the more conservative, pro-life states. They were hoping a legal challenge would eventually make the US Supreme Court revisit Roe v. Wade and ultimately overturn it. Colorado voters have twice rejected similar measures before. Despite losing in a very conservative state yesterday, the life-at-fertilization camp says they'll continue their efforts.

Parents Group Upset Over Teen Sex in Glee Tonight

The show hasn't even aired yet, and the Parents Television Council is already angry about the teen sex in Glee's episode tonight titled "The First Time." Two McKinley High couples - one straight and one same-sex - will be getting it on tonight, and the parents group isn't happy about it. While it would appear to be the gay teen sex PTC is targeting, the group's president Tim Winter says it's really about the age and audience.

"The fact that Glee intends to not only broadcast, but celebrate children having sex is reprehensible. The gender of the high school characters involved is irrelevant. Teen sex is now more prevalent on TV than adult sex and Glee is only playing into that trend. Research proves that television is a teen sexual super peer that can, and likely will, influence a teen's decision to become sexually active. Fox knows the show inherently attracts kids; celebrating teen sex constitutes gross recklessness."

While Glee is set in high school, I wouldn't call it a kids show, and it has been frank about sex since day one. The first season revolved around Quinn's teen pregnancy after all. And where was the PTC outrage when "The Power of Madonna" episode aired, which was all about getting in touch with your sexual side and losing your virginity, and featured various couples rolling around in bed? Instead, the PTC called out the Britney Spears episode for featuring a "troubled pop star" as a role model and, of course, that pervy Glee GQ photo shoot.

I can't find the rhyme or reason to what ruffles the parents group's feathers, but do you think something as common as teen sex on TV is really the issue?
