I really don't think that women who are voting for Sarah Palin would be swayed by this. It's the liberal media, right? and marriage is sacred, men are head of the household, etc. etc.

I really don't like Sarah Palin, but putting that aside: You just said that Ross denied making the comment about marital rape. Unless the women's rights groups making the accusation can back it up with proof, then they don't have a case against him on that subject. His poor track record caused by other comments shouldn't make him automatically guilty of this really terrible one.

Marital rape wasn't a crime until fairly recently. Until then, it was assumed that if a woman was married, she couldn't NOT consent to have sex with her husband.

Well for the purposes of PR I agree that Gov. Palin needs to drop him like a hot potato. As for his alleged comments well all we can do is wonder there's no proof.

Not that it is the case with Ross but I have seen many times where people were labelled defenders of this or that in a negative light simply because they were doing their jobs as public defenders or defense attorneys. If I'm defending someone on a professional level it doesn't mean that I am in agreement of their thoughts and actions. It's just my job.

Wayne Anthony Ross' attorney general nomination war ends with the legislature rejecting his nomination. The 35-23-vote marks state history's first time an agency head failed confirmation.

"I really hope folks in the body see through the smoke and hire a guy for the state of Alaska who will pursue our interests," Rep. Mike Hawker, R- Anchorage, said during debate.

Yeses, like Hawker, tried to persuade the body Ross' views had been distorted, and Ross was a man who would stand up for gun rights along with every Alaskans constitutional rights.

"Wayne Anthony Ross might be exactly the person to have at the helm of our judicial system," said Rep. Mike Kelly, R- Fairbanks.

Sen. Lynda Menard, R-Wasilla, said, "As a strong constitutionalists allow Wayne to protect all families rural and urban."

The nos, however, said Ross' main issue was Ross was not the best lawyer to be the state's top attorney.

Sen. Judiciary Chair Hollis French, D-Anchorage, said, "I love my state. I love my family. I have friends. That's not the question we have before us today."

The focus of the very intense hour-long debate started with social issues.

"His 19th century view of the gay community," French said.

Sen. Bill Wielechowski, D-Anchorage, added, "The question is will the attorney general nominee protect the rights of people he views as degenerates."

"In his own words I believe he has portrayed his attitude toward women is less then what I had hoped," House Minority Leader Beth Kerttula, D-Juneau, said.

Sen. Lyman Hoffman, D-Bethel, said, "The problem is Mr. Ross has been in this state for decades. And during those decades he has not been able to convince Native people he will look out for their interests."

"If you want to disregard that you can look at the most current example," Wielechowski said. "Because we do have one example where he's called upon to give his legal reasoning. And that's the senate appointment."

"To me Mr. President the most damaging has been Mr. Ross' handling of an issue that took place right here in the capital," French said.

French said Ross signing off on Palin sending Senate Democrats three names, for their vacant Juneau senate seat, to him, was an extremely important test.

"And I think Mr. Ross flunked it," French said

The lawmakers' attorney called Ross opinion illegal.

"It only took a couple hours to get back a very clear decision back that no that was a wrong legal call," Wielechowski said.

Right after the legislatures attorney issued her opinion Ross told reporters, "The most important thing that can be done by the Senate is not to argue what's legal and illegal but to appoint someone to represent Juneau."

"First of all the senate cannot appoint anyone" French said. "We don't have the power. The legal power to do so. The statute doesn't allow it. But more fundamental though was the somewhat out of the world suggestion that we not argue what's legal or illegal. That's a total admission that Mr. Ross had not really studied the statutes."

Ross' letter, Wednesday night, to lawmakers compounded the issue. Ross called his own statement a "false rumor."

"And now today his inability to admit to the same," French said. "We've all said things we shouldn't say. I've done it myself. I'll correct the record, or I'll apologize. That's the right thing to do."

Rep. Les Gara, D-Anchorage, ended debate saying, "When you're looking for the states top lawyer who is there to represent all Alaskans, all Alaskans regardless, I don't think this is the right nominee."

Palin called the rejection purely political, "I think it's going to be quite a challenge, from henceforth, if these politics of personal destruction plays continue to find candidates who are willing to put themselves through what Wayne just went through. So many lies told about him."

It would have taken 31 votes to approve Ross. Nine of the 35 no votes were Republicans, including Senate President Gary Stevens, R-Kodiak, House Speaker Mike Chenault, R-Nikiski, and House Majority Leader Kyle Johansen, R-Ketchikan. House Judiciary Chair Jay Ramras voted for Ross.

Only 19 senators voted because of the vacant Juneau Senate seat at the center of this controversy. Thursday, one of those three candidates, Joe Nelson, removed his name from consideration saying it is obvious no matter how qualified he or any of the other candidates are Nelson feels Senate Democrats will only support a candidate the Juneau Democrats support.

As this session comes to an end, for the first time in many years, the defining issue has not been the pipeline, or taxes, but the contention between lawmakers and the governor.
