South Korea's high court upheld an adultery law that can send people to jail for having an extramarital affair last week. It has been called anachronistic and an infringement on personal freedom by critics.
The appeal made to the Constitutional Court since 1989 was brought by the lawyers for a popular actress who was charged when her actor husband filed a criminal complaint against her for having an affair with an opera singer. The law was enacted in 1953 to protect women because the male-dominated society offered women little protection when a husband had an affair. At the time when a wife walked out of a marriage, she would often end up penniless.
Today, it is rare for people to actually serve jail time, but several thousand spouses file criminal complaints yearly. Five judges found the law unconstitutional, one short of the six needed to strike it down. Do you think the law is fair in 2008?

Kudos! really kudos to that. I have so many friends from that part of the world and women have very little rights when husbands cheated and believe me they do often. I think they should correct the marriage laws on assets as well. Not only does he go to jail, he has to let goes of half of his assets. That should be a ground for a good divorce for the wives
1Great in theory, but if no one's actually been going to jail, what good does it do?

2I agree with bluesteyes he has to give over half of all the assets he amasses during the marriage. This should be adopted in all the developign countries where women still have to start from scratch when their husbands leave them. I don't think going to jail helps anything though but it must feel great to see the lying scumbag in a cell.
3There should be a big fine payable to the person cheated on...
(honestly though, if people would take my advice and treat marriage as a contract rather some quasi-governmental-religious pile of confusion - the cheated on would sue for breach get damages and the cheater would be poor but have the promiscuous freedom to be a douchebag as much as they want)

This seems plausible... after all, getting married requires a legal contract, and adultery severs all the fundamental rules set up by this contract. Jail sounds about right.

10Jail?? Well that's a little much. Karma usually comes around and bites the cheater in the arse anyway. Heck the woman my ex-husband left me for accused him of stealing her car and had him arrested. He now sits in a Colorado prison. So it all worked out in the end with out the help of the government. lol

13Well and the best form of revenge too I've found is to just live your life and be happy. I remember talking to my ex before he went to prison and he would hear happiness in my voice and hear all the things I was doing with my time not thinking about him and I could tell how much he hated it.
